ABOUT THE JOB:
The Claim Specialist is a critical role focused on managing one of the highest-risk areas of construction: contractual claims and disputes. Working within the Contract, Risk and Claim Management Unit, you will be responsible for the detailed preparation, substantiation, and defense of construction claims. Your ability to build a robust, evidence-based case is essential for protecting OVID's financial interests and ensuring fair outcomes in contractual disagreements.
Job Requirements:
Education: BSc in Civil Engineering, Quantity Surveying, or Construction Management. A legal qualification or postgraduate degree in Construction Law is a strong advantage.
Experience: Minimum of 7-10 years of experience in the construction industry, with a significant portion dedicated to claims preparation and management.
Job Competencies:
Experience in dispute resolution proceedings (arbitration, adjudication).
Membership in a relevant professional body (e.g., CIArb, DRBF).
Experience with FIDIC contracts.
Core Professional Skills
Technical Skills: Deep understanding of contract law, delay analysis methodologies (time impact analysis, windows analysis), and quantum assessment. Expert proficiency in planning softSituatione (Primavera P6) for delay analysis.
Analytical Skills: Exceptional analytical, documentation, and report-writing skills.
Attention to Detail: Meticulous attention to detail and ability to build rigorous, evidence-based cases.
Duties and Responsibilities
1. Claim Preparation:
Lead the preparation of comprehensive and well-substantiated construction claims, including extension of time (EOT) and additional payment claims.
Gather, analyze, and organize all necessary documentation to support claim submissions (e.g., schedules, costs records, correspondence, site records, photographs).
Prepare detailed claim narratives, explaining the factual and contractual basis for the claim.
Quantify claim amounts and delays using appropriate methodologies (e.g., time impact analysis, measured mile analysis).
2. Claim Defense:
Assist in the development of defense strategies against claims made by contractors or clients.
Analyze claims received to assess their validity and quantum.
Gather evidence and prepare responses to claims.
Support negotiations by providing technical and contractual analysis.
3. Dispute Resolution Support:
Support the Contract and Risk Manager in negotiation and dispute resolution processes, including adjudication or arbitration.
Prepare documentation and evidence for dispute resolution proceedings.
Assist in preparing expert reports and witness statements.
Liaise with external legal counsel as required.
4. Lessons Learned:
Maintain a lessons-learned database from past claims to improve future contract and project management.
Contribute to the development of best practice guidelines to minimize future claims.
Share insights with contract engineers and project teams to improve contract administration.
5. Knowledge Management:
Stay abreast of developments in construction law and claims jurisprudence.
Maintain a library of claim precedents, legal decisions, and industry best practices.
Support training initiatives on claims a situationeness and prevention.
